Terms of Use

These terms are an agreement between you and NapTime Labs LLC ("we", "us"), the maker of the Recall app. By creating an account or using Recall, you agree to them. If you don't agree, please don't use the app.

1. Who can use Recall

You must be at least 13 years old. If you are under 18, you need a parent or guardian's permission. You are responsible for keeping your sign-in details secure and for everything that happens in your account.

2. Your content

The people, notes, and other information you add to Recall are yours. You give us permission to store, process, and display that content only so we can run Recall for you. This includes sending note text to our AI provider to create summaries and briefings, as described in our Privacy Policy.

Recall is for your personal notes about people you actually know or meet. You agree that you will not use it to:

3. AI-generated content

Recall uses artificial intelligence to write summaries, pull out key facts, and prepare briefings from your notes. AI can make mistakes, miss things, or state something with more confidence than it deserves. Treat what it writes as a helpful draft, and check anything important against your own notes.

4. Free plan and Recall Pro

Recall is free for up to 5 people. Recall Pro removes that limit. Pro is an auto-renewing subscription sold through Apple's App Store at the prices shown in the app before you buy.

If your Pro subscription ends while you have more than 5 people, you keep all of them and can still view and edit them. You won't be able to add new people until you are back under the limit or subscribe again. We may change prices or plan features in the future. Changes to an existing subscription's price will follow Apple's rules and notice requirements.

5. Our app

Recall, including its design, code, name, and Ellie the elephant, belongs to NapTime Labs LLC. We give you a personal, non-transferable license to use the app on Apple devices you own or control, for your own non-commercial use, under these terms and Apple's Usage Rules.

We are constantly improving Recall, so features may change, and we may stop offering some of them. If we ever shut Recall down, we will give you reasonable notice and a way to get a copy of your notes.

6. Ending your use

You can stop using Recall at any time and delete your account in Settings. Deleting your account permanently deletes your content. It does not cancel an Apple subscription, so please cancel that separately.

7. Disclaimers

Recall is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the app will be uninterrupted or error-free, that reminders will always arrive, or that your content will never be lost. Keep your own copy of anything you can't afford to lose.

8. Limitation of liability

To the fullest extent the law allows, NapTime Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of Recall. Our total liability for any claim relating to Recall is limited to the greater of the amount you paid us for Recall in the 12 months before the claim and $50. Some places don't allow these limits, so they may not all apply to you.

9. Indemnity

If someone brings a claim against us because of content you stored in Recall or your misuse of the app, you agree to cover our reasonable costs of that claim, to the extent the law allows.

10. Apple

These terms are between you and NapTime Labs LLC, not Apple. Apple is not responsible for Recall or its content, and has no obligation to provide maintenance or support for it. If Recall fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Recall. Apple is not responsible for addressing any claims relating to Recall, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You confirm that you are not located in a country subject to a U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

11. Governing law

These terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, and you and we agree to those courts' jurisdiction. This does not take away any rights you have under the consumer protection laws of the place where you live.

12. Changes to these terms

We may update these terms. If a change is significant, we will let you know in the app before it takes effect. If you keep using Recall after that, you accept the new terms.
